I <a href=\"https:\/\/www.firstpost.com\/india\/kerala-nun-rape-case-is-indias-spotlight-moment-role-of-state-more-important-than-ever-in-this-battle-with-church-5160231.html\"><strong>write for Firstpost<\/strong><\/a>&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Oscar winning film Spotlight\nlooked at the investigation into child sex abuse by priests of the Catholic\nChurch, and how the Church when told about these crimes, rather than take\naction tried to cover up, sending the priests to new parishes where they could\ncontinue abuse unchecked. India has her own Spotlight moment. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It has been over two and a half months since a Kerala nun filed a FIR alleging that Bishop Franco Mulakkal of the Roman Catholic Diocese (Jalandhar) had raped her over a dozen times in the last two years. This caused shockwaves in the church, the Catholic community, and in society at large. Since then, there have <strong><a href=\"https:\/\/cruxnow.com\/church-in-asia-oceania\/2018\/09\/08\/more-nuns-accuse-bishop-in-india-of-inappropriate-touching\/\">been other nuns who have come forward<\/a><\/strong>with accusations of abuse by the same Bishop. Since the 29<sup>th<\/sup> of June, when the nun filed the charges, the police have been investigating the charges. Given the organisational might of the Church, the investigations are moving at a snail\u2019s pace. After a protest by others nuns on the inaction on this issue,&nbsp; <strong><a href=\"https:\/\/indianexpress.com\/article\/india\/kerala-nun-rape-case-probe-dragging-hc-asks-cops-to-submit-action-taken-report\/\">the Kerala HC has directed the police<\/a><\/strong> to submit an action taken report.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the meantime, the intimidation\nof the survivor has begun. She is a survivor on multiple levels. At the first\nlevel is the sheer case of the power differential between the Bishop of\nJalandhar and the nun. In a strictly hierarchical organisation like the Church,\nthe gap between a Bishop and a nun is huge.&nbsp;\nFemale nuns are in any case, not thought to be equal to male priests.\nAnd, this translates to how secular criminal justice system views the two. <strong><a href=\"https:\/\/www.telegraphindia.com\/india\/scandals-bind-communists-and-church-258438\">The\nnun has already been interviewed<\/a><\/strong> by the police 10 times, the\nBishop only once. And, there is a tremendous inertia in moving the case ahead<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This difference in power has an\neven more devastating consequence for the nun as a member of an organisation \u2013\nnamely the Missionaries of Jesus, a Roman Catholic order for women. She has\nbeen vilified by her own organisation. And, there is the entire organisational\nmight of the order against her. The <strong><a href=\"https:\/\/www.thenewsminute.com\/article\/missionaries-jesus-shields-rape-accused-slams-nuns-taking-innocent-bishop-88129\">Missionaries\nof Jesus<\/a><\/strong> have come out in support of the Bishop, calling him an\n\u2018innocent soul\u2019; and saying they were ashamed of the protesting nuns. Just to\nemphasise the point, the Missionaries of Jesus are a female order, that are\nsupporting a powerful man accused of rape, while shaming the survivor. At the\nthird level is the public abuse and intimidation, by powerful men close to the\nChurch. Recent comments by Poonar MLA, PC George comparing the nun to a\nprostitute brought him a rebuke from all sides. But, the damage is done.\nSurvivor shaming is an old game in rape cases, and the powerful use it well to\ntheir advantage. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This story has been played out many\ntimes in the national and international media. A powerful man with powerful\nfriends, made all the more powerful by the backing of organised religion, in\nthis case the Catholic Church, v\/s the powerless survivor of sexual assault \u2013\neither a child or adult. The tendency for the rich and powerful to make a deal\namongst themselves to protect their own, and sweep the victim under a carpet is\nhuge. But, that does not serve the interests of justice. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And, this is where the State comes\nin. The role of the state in a democratic, secular, republic, is to protect the\nrights of the individual, not of organisations or cabals of the powerful. And,\nthis is where the State needs to act. This is not a Church matter. It is not up\nto the Church to exile or reassign the Bishop. It is a state matter. And, it is\nnecessary for the state to act. Rape is a crime and the punishment for this has\nto be meted out by the criminal justice system. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And, this is what is meant by being\ntruly secular. Truly secular is not giving a free pass to all transgressions by\nsenior members of organised religion. Truly secular is ignoring those\naffiliations in the pursuit of justice. The state must become blind to the\nreligious associations of the survivor and the accused and look at it as a case\nwhere the Indian Penal Code has been violated, and rights of a citizen have\nbeen trampled upon; and work in the interests of the survivor to deliver\njustice. And, therefore in the interests of justice, the Bishop needs to be\ntreated not as a member of a powerful organisation, but as any man accused of\nrape. And, that means him being arrested for the crime. This is what the state\nneeds to do.
