{"id":6511,"date":"2018-10-11T08:59:54","date_gmt":"2018-10-11T03:29:54","guid":{"rendered":"http:\/\/calamur.org\/gargi\/?p=6511"},"modified":"2019-04-14T15:26:47","modified_gmt":"2019-04-14T15:26:47","slug":"cnbc-tv18-title-the-aadhaar-judgement","status":"publish","type":"post","link":"https:\/\/calamur.org\/gargi\/2018\/10\/11\/cnbc-tv18-title-the-aadhaar-judgement\/","title":{"rendered":"CNBC TV18 Title : The Aadhaar Judgement"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">I write for <a href=\"https:\/\/www.cnbctv18.com\/economy\/aadhaar-verdict-supreme-court-has-delivered-a-good-judgement-for-the-majority-937891.htm\"><strong>CNBC TV18 on the Aadhaar Judgement<\/strong><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Does the State have the right to\nknow all information about its citizens, via a single large shared database that\nis linked to all government and private services the citizen may use? Is it\neven constitutional? The Supreme Court verdict on Aadhaar, seems to be both a\nyes and a no to this question. While the court, in a 4-1 majority decision,\nupheld the Constitutional validity of Aadhaar, it has clamped down on the\nubiquitous role that the Government had envisaged for it. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aadhaar is a twelve-digit unique\nidentity number issued by the UIDAI \u2013 Unique Identification Authority of India,\nthat was supposed to be issued to each and every resident of India and based on\ntheir biometric and location data. The Aadhar Act defines a resident as being\nsomeone who has resided for more than 182 days in the country, preceding\nenrolment, and has the appropriate paperwork. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;Introduced by the UPA Government in 2009, it\nbegan life as a department of the planning commission. &nbsp;&nbsp;Its aim was noble \u2013 to ensure that no\nresident of India is deprived of the services and subsidies that they were\nentitled to receive from the Government of India. The UPA government erred in\nnot bringing this via Parliament. This error was rectified, in part, by the NDA\nGovernment which passed a money bill in 2016, and provided the legal backing\nneeded to make Aadhaar mandatory for the receipt of welfare. However, the\ngovernment overextended the scope of Aadhar and tried to make it mandatory for\npretty much everything that needed proof of identity. And this transformed\nAadhaar from being a system that was supposed to be inclusive, to being one\nthat excluded those who had no Aadhaar from a variety of benefits. There was\nalmost a missionary like zeal in implementing, leading officials to see the\ngoal of Aadhaar as being compulsory enrolment, and not the delivery of\nservices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;<strong><a href=\"https:\/\/uidai.gov.in\/images\/the_aadhaar_act_2016.pdf\">Section\n57 of The Aadhaar<\/a><\/strong> (Targeted Delivery Of Financial And Other\nSubsidies, Benefits And Services) Act, 2016 specifically stated \u201cNothing\ncontained in this Act shall prevent the use of Aadhaar number for establishing\nthe identity of an individual for any purpose, whether by the State or any body\ncorporate or person, pursuant to any law, for the time being in force, or any\ncontract to this effect\u2026\u201d ; and this opened the door for the private sector\nentities such as banks and mobile companies to demand Aadhaar linking as a\nnecessary&nbsp; condition of doing business\nwith them. IT became mandatory for school admissions and participating in\nsports events. It became necessary to have one to get admitted to hospitals and\nget discharged from them. Aadhaar slowly went from being a method of delivering\ngovernmental services and subsidies to be a single number that linked us all. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That really is what the Supreme\nCourt has struck down. Section 57 is gone. Also gone is section 33 (2) which allowed\nthe sharing of detailed information for National Security purposes. It was\nbelieved that a combination of all our transactions linked to the Aadhaar, and\nthe scope of the National security exceptions would gravely impact our liberty\nat a future date. And, the Supreme Court concurred and read down, or struck\ndown those parts of the Act that allowed for these lapses. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The gist of the majority verdict is\nthat while the Government can mandate it for the delivery of welfare services,\nand while PAN card needs to be linked with Aadhar, it is not compulsory for\nanything else. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are those on both sides who differ\nwith this judgement. The pro Aadhaar brigade has spoken about us voluntarily\ngiving away our data to large conglomerates like Facebook and Twitter; while\nresisting Aadhaar. The fact remains, while they may have a glimmer of a point,\nit is not mandatory to link your Facebook account to your bank account. For the\nanti Aadhar brigade, vital privacy issues are still ignored. However, the\nSupreme Court has suggested that the Government brings in a data protection\nact, that would go some way in addressing the situation. But neither side is\ngoing to be assuaged with any of the reasons. These are in many ways, the\nAadhaar fundamentalists. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the vast majority, this is a\ngood decision that allows for a system that targets the needy, delivers what is\npromised, and eliminates leakages. What is needed now is a bit of compassion\nand empathy in dealing with those who don\u2019t have an Aadhaar card, and deliver\ntheir entitlements while they enrol. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>I write for CNBC TV18 on the Aadhaar Judgement Does the State have the right to know all information about its citizens, via a single large shared database that is linked to all government and private services the citizen may use?
