However, in practise, we are held hostage by disparate groups who are easily offended, and use existing laws to stifle free speech, and individual freedoms. This has to change. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Odisha, a man was released from\nprison after 40 days. His \u2018crime\u2019 \u2013 his joke offended people. For the last 6\nweeks, journalist and defence analyst <strong><a href=\"https:\/\/www.news18.com\/news\/india\/the-predicament-of-journalist-abhijit-iyer-mitra-caught-in-the-tangle-of-law-1943381.html\">Abhijit\nIyer Mitra<\/a><\/strong> had been under lock and key. A prisoner of the state\nof Odisha, while awaiting prosecution for offending sentiments. Abhijit Iyer\nMitra\u2019s crime? He had recorded a video where he disparaged the Konarak Temple.\nAnd, he was rude about the Odisha legislature. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Manipur, journalist <strong><a href=\"https:\/\/www.news18.com\/news\/india\/manipur-journalist-arrested-under-draconian-national-security-act-for-facebook-post-against-pm-modi-bjp-1956547.html\">Kishorechandra\nWangkhem<\/a><\/strong> has been arrested under the National Security Act (NSA)\nfor asking the state Government, on video, what Rani Laxmibai had to do with\nthe freedom movement in Manipur. A few days earlier he had been arrested under\nsedition, and the judge saw nothing seditious with his video. Wangkhem used\nexpletives for while describing the Chief Minister of the state N Biren Singh,\nand politicians at the centre. Unfortunately, swearing is seen by some as an\nassertive way of making a point, and while it is a wrong assumption, it should\nnot be a violation of National Security. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Karnataka journalist&nbsp; <strong><a href=\"https:\/\/www.news18.com\/news\/india\/karnataka-journalist-arrested-for-hate-speech-against-tipu-jayanti-released-on-bail-bjp-demands-quashing-of-fir-1938235.html\">Santosh Thammaiah<\/a><\/strong> was arrested for making a speech that was disparaging of Tipu Sultan. Thammaiah questioned the state government about having Tipu Sultan celebrations, which in his opinion was not warranted. And, while Tipu Sultan may be a hero to many, there are those who have issues with his record as a ruler. And, it is perfectly alright to hold that opinion and express it. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;These are three cases have hit the news cycle,\npossibly because the arrested were journalists, and had friends who were\njournalists and who could bring these stories to light. However, there more\ncases where we don\u2019t even get to hear about arrests. On paper, Indian citizens\nhave the right to free expression, the right to crack jokes, the right to voice\nopinions. However, in actuality, most of us are muted by the select few who get\n\u2018insulted\u2019 by the exercise of free speech and use existing laws, aimed at\npreventing riots, to stifle speech and freedoms. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both Iyer Mitra and Thammaiah have\nbeen booked under section 295 (A) that charges them with deliberately hurting\nreligious sentiments. And, Wangkhem has been charged under the National\nSecurity Act. While politicians get away with incendiary speeches at election\nrallies, and abusing each other \u2013 these three men are facing some very serious\ncharges. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;\u201c <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In effect we are telling citizens\nthat if others find your words offensive and riot, then you are culpable for\ntheir loss of control. And, there is something completely skewed by this kind\nof logic. We shouldn\u2019t comment on history because people might be offended. We\ncan\u2019t question religion because some people may be offended. We can\u2019t eat\ncertain kinds of food, because some people may be offended. We cannot make\ncertain kinds of films, or show certain kinds of interpretations, because\npeople may be offended. People who get offended and issue threats or commit\nviolence are not charged with crimes. People who speak and express are. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For an individual to go up against\nthe state, to defend themselves, is a monumental task. Between the police\nstations, and the courts, and the final judgement, you can spend a lifetime\ntaking on the system and get nowhere. It is often easier to grovel out an\napology, and move on. And every time that happens, everyone\u2019s freedoms get\nreduced just a wee bit more. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India needs to have an agency that\nlooks at defending individual rights and the right to free expression, and if\nneeded, the right to offend. And, this agency needs to defend the constitutional\nrights irrespective of the political leaning of the person whose rights are\nunder attack. The rights of the individual have to be greater than the\ncollective rage of groups. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Freedom of expression will cause\noffense to some. For example, an atheist telling a devout person that they\nthink there is no god, can be considered by some to be offensive; while others\nmay get offended by the concept of evolution; yet others might get offended by\nbeing told that they lost a war sometime in the distant past. While hate speech\nneeds to be curtailed, every criticism, opinion, &nbsp;or joke is not hate speech. The state cannot\npenalise people for expressing opinions. If anything, it needs to be harder on those\nwho cause violence after being offended. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a constitutional republic with a\nfocus on individual rights, jokes and rude comments should be perfectly\nacceptable. Alas, in India the concept of individual rights is being pummelled\nby the collective rage of select groups. And strangely enough, the reactions on\nsocial media and in the real world are quite aligned \u2013 that people should be\ncareful about hurting the sentiments of others. The problem with the premise is\nthis, any view or opinion can hurt the feelings of someone.
