{"id":7523,"date":"2019-08-04T12:35:07","date_gmt":"2019-08-04T12:35:07","guid":{"rendered":"http:\/\/calamur.org\/gargi\/?p=7523"},"modified":"2019-08-04T12:35:18","modified_gmt":"2019-08-04T12:35:18","slug":"cnbc-tv18-column-broken-windows-and-broken-laws","status":"publish","type":"post","link":"https:\/\/calamur.org\/gargi\/2019\/08\/04\/cnbc-tv18-column-broken-windows-and-broken-laws\/","title":{"rendered":"CNBC TV18 Column: Broken Windows and Broken Laws"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">I <strong><a href=\"https:\/\/www.cnbctv18.com\/politics\/broken-windows-and-broken-laws-3963021.htm\">write<\/a><\/strong> about the broken down rule of law, for CNBC-TV-18<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Among the more inexplicable trends that exist today is gangs of people tying up others and <a href=\"https:\/\/scroll.in\/latest\/929701\/jharkhand-three-men-thrashed-in-ranchi-allegedly-forced-to-chant-jai-shri-ram-say-reports\"><strong>forcing them to chat<\/strong><\/a> religious and nationalistic slogans, before being beaten up. The first time it was reported, the reactions to it were shock. Most couldn\u2019t believe that this would take place in India. However, as more of them began to occur, with different degrees of brutality, the shock has turned to denial. There are many, mostly on the right of the political spectrum, who steadfastly believe that this is a conspiracy to defame the religion, the nation, and everything else that they hold dear.\u00a0 There are those, on the left of the spectrum, who believe that this is a sign of growing fascism in India. But, it isn\u2019t just one thing. Recently there was the story of a <a href=\"https:\/\/www.indiatoday.in\/india\/story\/delhi-temple-hauz-qazi-communal-tension-parking-row-exclusive-sanjiv-1561039-2019-07-03\"><strong>Hindu temple being desecrated and vandalised<\/strong><\/a> by a mob of people, irate at something or the other. The reactions on social media were similar. One side said it was a minor parking incident and a minor altercation. The other looked at it as an extension of terror. In the scheme of things, it doesn\u2019t really matter who the sides are, and what they support. What is important is their collective voice when it comes to denying a crime. It is almost as though the rule of law does not apply to the side they support.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These incidents have something else in common. The first is exposing the tinderbox of communal passions \u2013 that India knows too well. The start of the last century to almost the end, has  seen regular communal riots, where people kill each other, and everyone else in sight. The second issue is the exaggerated support to one side, and the toning down of the crime as being \u2018minor\u2019 as opposed to vandalization or murder. While social media warriors on both sides are out to prove that a \u2018crime\u2019 is not a crime, or indeed \u2018a communal crime\u2019 is not communal \u2013 the state cannot act like an ostrich. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We have a problem \u2013 and the problem\nis that people who commit crimes like this rarely get punished. In fact, it is\na way of climbing up the career ladder in politics. And, therefore the\nincentive to commit the crime is high \u2013 recognition and promotion \u2013 and the\npenalty for committing these crimes is low \u2013 rarely accompanied by a jail term.\nAnd, this is what various state governments must fix. The taking away of the\nadvantages accruing to the person for committing violence and leaving only the\npenalties for the infractions. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is another part to this\nentire set of actions \u2013 and that is the extremely slow response from state\ngovernment law and order machineries. For example, the first of the lynchings\non suspicion of eating beef was in 2015, when a mob of people broke into the\nhome of Mohammad Akhlaq and bashed his head in with a sewing machine. His <a href=\"https:\/\/www.dnaindia.com\/india\/report-dadri-lynching-mohammed-akhlaq-s-murder-accused-may-soon-secure-jobs-2552743\"><strong>alleged\nkillers were feted<\/strong><\/a> and are roaming free. It is hardly surprising\ntherefore that murder under the guise of cow protection, or protection of\nreligion, is becoming a somewhat profitable venture, that yields rich dividends\nfor those who commit the crime. When people see others getting away with crime,\nand profiting from it, the tendency to be less law abiding rises to the fore.\nAnd this is what the state governments need to curb with strong action. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/whatis.techtarget.com\/definition\/broken-window-theory\"><strong>Broken\nWindows<\/strong><\/a> is a theory in sociology that looks at the impact of unchecked\ncrime and disorder in modern settings. It says that for police to maintain law\nand order, and relative peace in society, they have to tackle the more visible\naspects of minor crime. For example, vandalism, or \u2018eve teasing\u2019, or petty\ncrime. It is when these are tackled on a regular basis, and the word goes out\nthat the police mean business when it comes to maintaining law and order, that\nthe message goes out that terrorising people or vandalising structures will no\nlonger be acceptable. So, focusing on minor crimes, ends up preventing major\ncrimes. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While it is important to arrest\nthose who break the law \u2013 be it gau rakshaks or those who vandalise temples \u2013\nand sentence them to the full extent of the law, prevention is a vital part of\ncure. Crime has to be nipped in the bud, before it spreads across society. And,\nthat means a focus on community level policing. It is to make sure that laws\naren\u2019t broken. That gangs of men don\u2019t bully women. That there is no illegal\nparking. That there is no infringement of public space by shops and other\nestablishments. That no one seemingly gets away with crime. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reason why crimes like this\ntake place is two fold. The first is the belief that you will get away with it.\nThe second is that you will be rewarded for it, in terms of career growth and\nprogression. It is time to clip the first. If a person goes to jail for\ncommitting a crime against others, then it acts as a huge deterrent for others.\nRight now, we are seeing copycat crimes that dot the Indian landscape, simply\nbecause people are getting away scot free.
